Abstract

The article deals with the issue of evidentiary value of consignment note in the light of Polish domestic law, CMR Convention and CIM Convention. The author presents the differences between the regulations of particular acts, stating that the provisions of CMR Convention are the most clear and balanced ones. This is a consequence of the fact that this act clearly defines the role of consignment note and its relation to the other proofs, maintaining necessary flexibility at the same time. The regulations of CIM Convention may raise some doubts regarding the far-reaching preference of the carrier, which places him in much more advantageous position than the sender and leads to the violation of the balance between the parties to the contract of carriage. In case of Polish transport law the evidentiary value of the consignment note is not precisely regulated. In particular it is not possible to determine its relation to the others proofs, which justifies the need of the amendments of the act in this regard.
