Abstract

A consignment note constitutes proof of the contract, including the agreed terms and acceptance of the goods by the carrier. Since the Convention does not require the issuance of separate letters to each vehicle, type or lot, it may be necessary for the Notary Public to make a a certified copy of the document. To do so, a notary public is entitled to act as a public trustee under his or her authority. However, to be able to do so, it is necessary to consult the original document which is to be certified (in writing). Bringing attestation only to the mechanical operation of a notary casts doubt on the validity of the existence of this activity within his competence as a lawyer. The Notary, when certifying the consignment note, should not only read the contents of the consignment note, but also verify it in the sense of examining its compliance with the law.
