The performance of tourist services in today’s legal realities proves to be a long-term and at the same time complicated in legal terms. This is for many reasons. One of the most important is the multiplicity of legal regulations covering the matter under consideration, while at the same time necessitating the use of European law, especially in the case of transport contracts, while providing cross-border transport services. Against this background, the liability of carriers in bankruptcy is one of the most important problems in the recovery of claims against carriers operating under different legal systems. From the point of view of the complexity of the liability of the carrier in bankruptcy for non-performance of the passenger transport contract, its analysis was limited only to selected issues. At the same time, such an activity has undoubtedly contributed to the clarification of many doubts, which in practice cause many problems, especially when the consumer with the least knowledge in this regard is the weakest link in this chain of obligations in the event of non-performance of the transport contract.
