Abstract

The article attempts to assess the legal nature of the act consisting in the delivery of goods by the carrier in the carriage of goods by road. The author considers the above-mentioned problem on the basis of national regulations in the light of the Civil Code and the Transport Law, and with reference to international regulations of the CMR Convention. The analysis of theoretical aspects of the legal act leads to the conclusion that the delivery of goods by the carrier after their arrival at the place of destination does not constitute a legal act due to the lack of the basic requirement – a declaration of will. The delivery of goods is only a factual act, being a part of the performance of an obligation and having certain legal consequences. However, these consequences are independent of the carrier’s will and result only from the applicable legal regulations. Consequently, it is not possible to apply provisions concerning the rules of making declarations of will, forms of legal acts, defects of declarations of will, as well as the provisions regarding power of attorney.
