The multimodal carrier's liability for non-localized loss

Abstract
The aim of this article is to determine the proper regime of the carrier’s liability for the loss of goods when the loss cannot be attributed to the specific stage of multimodal carriage. The author points out the situations in which the regime of the carrier’s liability is directly defined by the domestic or international transport law. However there are many situations when finding the proper regime is more difficult. The author is of the opinion that a multimodal carriage contract is of a mixed nature. The methods of ascertaining legal effects of mixed contracts can be helpful in determination of legal effects of a multimodal carriage contract including rules of the carrier’s liability.
