Abstract
The subject of this paper is to point out the need for change in the regulation of claims in the Act of 15 November 1984 Transport Law. After analyzing the applicable laws the authors postulate to change the nature of claims from compulsory into optional. At the same time they are of the opinion that it is not necessary to regulate in the Transport Law the matters as form and the content of claims or compulsory attachments. It is not necessary to specify the time limit of suspension of the limitation period by claims as well as the so-called complaint procedure. The act’s regulation should be limited to the provision stating that a claim defining its base and the amount or the grounds for calculation thereof suspends the period of limitation until such date as the carrier rejects the claim by notification in writing and returns the documents attached thereto if the documents were attached in the original.
