Abstract
Within the amended Bankruptcy Law, liabilities arising for a bankrupt prior to the date of bankruptcy petition are being satisfied from the bankruptcy estate. On the other hand, liabilities arising after that date are being satisfied up to date, since they fall under the so-called “costs of bankruptcy proceeding”. In the light of the above, the moment of bankruptcy petition is of particular importance in terms of a method of an indulgence of a claim of tenancy and lease that are provided periodically, in relation to a bankrupt. It is by cause of Bankruptcy Act introducing to the proceeding of liquidation bankruptcy a new rule of proportional claim division – to the part of a claim that is going to be satisfied from division of the bankruptcy estate funds and, to the part of that claim, that is going to be the cost of bankruptcy proceeding. The foregoing is the subject of present elaboration.
